Legal · v1.0 · Effective 01 May 2026

Terms &
Conditions

These terms govern your use of CREATE Landing Pages services. By instructing us to begin work, or by paying for any service, you agree to be bound by these terms in their entirety.

Version 1.0 · Effective 01 May 2026

B2B only

These terms apply only to business clients. CREATE Landing Pages is a B2B service and does not contract with consumers under the Consumer Rights Act 2015. By placing an order, you confirm you are acting in the course of business.

1. Definitions

In these terms:

2. The agreement

  1. These terms, together with the Scope of Work and any signed Brief, form the entire agreement between you and us.
  2. In the event of any conflict, these terms take precedence over the Scope of Work, and the Scope of Work takes precedence over the Brief.
  3. No other terms apply, including any terms you may seek to impose through purchase orders or your own standard terms of business.
  4. These terms supersede all prior discussions and proposals.
  5. We may update these terms from time to time. The version that applies to your project is the version in force on the date your payment is received.

3. Ordering and acceptance

  1. To order, you select a tier and pay the full price via our website checkout.
  2. Your order is an offer to purchase the Services. We accept your offer when we send you a written order confirmation.
  3. We reserve the right to decline any order, including where capacity does not allow it or where we have reason to believe the order is fraudulent.
  4. If we decline your order, we will refund any payment received in full within 5 working days.

4. Scope of services

  1. The exact deliverables for your project depend on the tier you have purchased.
  2. Anything not expressly listed in your tier's inclusions or in your signed Brief is out of scope.
  3. Out-of-scope work is available as a paid add-on at the prices published in the Scope of Work.
  4. We will not begin any out-of-scope work without your written approval and, where the add-on price is over £100, separate payment in advance.

5. Prices and payment

  1. All prices are in GBP and exclusive of VAT. We are currently below the UK VAT registration threshold; if our VAT status changes, we will charge VAT at the prevailing rate.
  2. 100% of the tier price is payable in advance, before any work begins. We do not offer deposit/balance arrangements, payment plans, or invoiced credit terms.
  3. Payment is taken via Stripe at the point of order.
  4. Add-ons agreed during the project are invoiced separately and must be paid before the corresponding work begins (over £100) or before launch (under £100).
  5. If payment is reversed, charged back, or otherwise withdrawn after work has begun, all work stops immediately. We reserve the right to recover unpaid amounts plus reasonable costs of recovery, including statutory interest under the Late Payment of Commercial Debts (Interest) Act 1998.

6. Timelines and delivery

  1. Each tier has a published turnaround time stated in working days (or, for Tier 04, in calendar hours).
  2. The clock starts on the working day after we have received: cleared payment, completed brief, all copy/content/images/assets, and your written sign-off of the project Brief.
  3. If any of the above is incomplete or late, the start date moves accordingly. We do not absorb delays caused by missing information.
  4. If you become unresponsive for more than 48 working hours during the project, the timeline pauses until you respond.
  5. If we miss a published timeline through our fault and not yours, your sole remedy is a 10% refund of the tier price for delays of up to 3 working days, or a 20% refund for delays of 4 or more working days.
  6. For Tier 04, the 24-hour clock is calendar hours. The clock pauses if you do not respond to questions within 30 minutes during the agreed working window.

7. Your obligations

To enable us to deliver the Services on time and on scope, you must:

  1. Provide accurate, complete and lawful information in your discovery brief.
  2. Provide all copy, images, brand assets, account credentials and other materials by the dates we specify.
  3. Sign off the project Brief in writing within 24 hours of us sending it (Tiers 01–03) or within 30 minutes (Tier 04).
  4. Respond to questions and revision proofs within reasonable timeframes (max 48 working hours for Tiers 01–03, 30 minutes during the agreed window for Tier 04).
  5. Bundle revision feedback into a single consolidated written response per round.
  6. Ensure that all materials you provide are lawful and that you have the rights to use them.
  7. Pay any add-on charges promptly and in advance where required.

8. Revisions and sign-off

  1. Each tier includes a set number of revision rounds as stated in the Scope of Work.
  2. A revision round is one consolidated written batch of feedback from you, applied in a single editing pass. Multiple separate emails count as separate revision rounds.
  3. Revisions are limited to refinement of work already produced under the signed Brief. Changing the page goal, audience, structure, or core messaging after sign-off is a scope change, not a revision, and is chargeable as an add-on.
  4. You are deemed to have approved each version of the deliverables if you do not provide written feedback within 5 working days.
  5. Final sign-off is your written confirmation that the deliverables are ready to launch. Once given, any further changes are chargeable.

9. Cancellation and refunds

  1. As a B2B service, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 do not apply. You have no statutory right to cancel.
  2. If you cancel before the build phase has begun, we will refund the tier price less an administration fee of £75.
  3. If you cancel after the build phase has begun, no refund is payable.
  4. We may cancel your order and refund the full price if we cannot deliver due to capacity or technical issues, or if you breach these terms.
  5. Refunds are processed within 5 working days of cancellation being agreed.

10. Intellectual property

  1. On receipt of full payment, you receive a perpetual, worldwide, royalty-free licence to use, modify, host, copy, distribute, and display the deliverables for any lawful business purpose.
  2. On written request following full payment, we will assign to you the copyright in any bespoke code, copy, and design produced specifically for you. Generic frameworks, libraries, design systems, and reusable components remain our property and are licensed to you.
  3. Stock images, fonts, plugins and third-party software included in your deliverables are licensed under the relevant third-party licence, not assigned to you.
  4. We retain the right to use your project as a portfolio reference. If you require this not to happen, you must tell us in writing before the project begins; an additional fee of £150 applies for portfolio exclusion.
  5. All pre-existing intellectual property — methodologies, processes, design systems, the CREATE brand — remains our exclusive property.

11. Materials you provide

  1. You retain ownership of any materials you provide to us.
  2. You grant us a non-exclusive, royalty-free licence to use those materials solely for delivering the Services.
  3. You warrant that you own or are licensed to use everything you provide, and that our use will not infringe any third-party rights.
  4. You indemnify us against any claim arising from a breach of clause 11.3.

12. Hosting

  1. Tiers 01–04 include 12 months of managed hosting from the date of launch.
  2. Hosting is provided on UK-based third-party infrastructure. We do not guarantee uninterrupted hosting and are not liable for downtime caused by the underlying provider, force majeure, or events outside our reasonable control.
  3. After 12 months, you may renew with us at our then-current rate (currently £20/month), migrate to your own host, or decommission the page.
  4. If you do not renew and we have not received your written instruction, your page may be taken offline 14 days after the renewal date. We will give at least 14 days' written notice.
  5. We reserve the right to suspend hosting immediately if your site is being used for unlawful purposes or generates abuse complaints.

13. Data protection

  1. In delivering the Services, we may process personal data on your behalf (leads captured via your landing page, contact form submissions, analytics records). In relation to that personal data, you are the Data Controller and we are the Data Processor under the UK GDPR and Data Protection Act 2018.
  2. We will: (a) only process personal data on your documented instructions, (b) ensure anyone authorised to process the data is bound by confidentiality obligations, (c) implement appropriate technical and organisational security measures, (d) not engage any sub-processor without your prior consent (which is granted for our standard sub-processors: our UK-based hosting provider, Stripe for payments, and the email tool you nominate), and (e) assist you with subject access requests, breach notifications, and DPIAs at your reasonable cost.
  3. We will notify you without undue delay (within 48 hours) of becoming aware of a personal data breach affecting your data.
  4. On termination of the hosting period or earlier termination, we will delete or return all personal data we hold on your behalf within 30 days, unless retention is required by law.
  5. You confirm that you have a lawful basis under the UK GDPR for collecting and processing the personal data captured via the deliverables, and that any privacy/terms templates we provide are reviewed by you (or your legal advisor) before use.

14. Confidentiality

  1. Each party will keep confidential any information disclosed by the other that is marked confidential or that a reasonable person would understand to be confidential.
  2. This obligation does not apply to information that is or becomes public other than by breach of this clause, was already known to the receiving party, or is required to be disclosed by law.
  3. This obligation survives termination for 3 years.

15. Warranties and disclaimers

  1. We warrant that the Services will be performed with reasonable care and skill in accordance with industry-standard practices.
  2. We warrant that for 30 days after launch, the deliverables will substantially function as described in your tier's Scope of Work and signed Brief, on the browsers and devices listed. If they do not, we will fix the defect at no cost.
  3. Beyond clauses 15.1 and 15.2, all other warranties are excluded to the fullest extent permitted by law.
  4. Without limiting the above, we do not warrant: (a) that the deliverables will produce any particular commercial result, conversion rate, lead volume, or ROI, (b) that the deliverables will be compatible with all future browser versions or third-party services, (c) that any third-party services or integrations will continue to operate as they do at launch, or (d) that the page will rank in any particular position on any search engine.

16. Limitation of liability

  1. Nothing in these terms limits or excludes our liability for: (a) death or personal injury caused by our negligence, (b) fraud or fraudulent misrepresentation, or (c) any other liability that cannot lawfully be excluded.
  2. Subject to clause 16.1, our total aggregate liability under or in connection with these terms is limited to 100% of the price you paid for the Services in the 12 months preceding the event giving rise to the claim.
  3. Subject to clause 16.1, we are not liable for: loss of profits, revenue, business, anticipated savings, goodwill, data, or any indirect or consequential loss whatsoever.
  4. You acknowledge that the prices reflect this allocation of risk.

17. Indemnity

  1. You indemnify us against all claims, losses, damages, costs and expenses arising from: (a) your breach of these terms, (b) materials you provided to us infringing third-party rights, (c) your use of the deliverables in any unlawful manner, or (d) your collection of personal data via the deliverables in breach of data protection law.

18. Termination

  1. Either party may terminate immediately by written notice if the other: (a) commits a material breach not remedied within 14 days of written notice, or (b) becomes insolvent or ceases trading.
  2. On termination: (a) you must pay all amounts owed up to the date of termination, (b) any licences granted to you are revoked unless full payment has been received, (c) we will return or delete your personal data and confidential information, and (d) clauses that by their nature should survive termination do so.

19. Force majeure

  1. Neither party is liable for any delay or failure to perform due to a Force Majeure Event.
  2. If a Force Majeure Event lasts more than 30 days, either party may terminate on written notice, with a pro-rata refund for any Services not yet delivered.

20. General

  1. These terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction.
  2. Before issuing court proceedings, the parties will attempt in good faith to resolve any dispute through direct negotiation within 14 days.
  3. If any provision is held to be invalid, the remaining provisions continue in full force.
  4. Failure or delay by either party to enforce any right is not a waiver of that right.
  5. These terms do not create any partnership, joint venture, agency, or employment relationship.
  6. No third party has any rights under the Contracts (Rights of Third Parties) Act 1999.
  7. We may sub-contract or assign any part of the Services without your consent. You may not assign without our written consent.
  8. All notices must be in writing and sent by email to the addresses given at order (for you) and to hello@createlandingpages.uk (for us).
